The short version
This summary is for convenience only. The full terms below are what legally apply.
- What you send stays yours. It is end-to-end encrypted on your device. We can’t read it, so you — not us — are responsible for it.
- Dragy moves files; it doesn’t keep them. Anything waiting in the cloud is deleted once it’s delivered, or after 7 days at most. It is not storage or backup — keep your own copies.
- Share links work for anyone who has them. Send them only to people you trust with the files.
- Use it fairly. No illegal content, malware, infringement, harassment or abuse of our relay and storage. See the Acceptable Use Policy.
- Dragy is free. If we ever add paid features, you’ll see the price before you buy.
- It’s provided “as is”, and our liability is limited as far as the law allows.
- UAE law applies, after an attempt to settle disputes informally. Mandatory consumer protections where you live still apply.
1. Agreement and who we are
Dragy is operated by [Nexlla Creative Agency — registered legal name], a [Legal form] trading as Nexlla Creative Agency, registered under licence number [Trade licence number] issued by [Licence issuing authority], with its address at [Registered address — street, building, city, Emirate, United Arab Emirates], United Arab Emirates (“we”, “us” or “our”). “You” means the person who uses Dragy and, where section 3.3 applies, the organisation on whose behalf they use it.
These Terms of Service, together with the documents they refer to — our Acceptable Use Policy, our Privacy Policy, our Copyright Policy and, for organisations, our Data Processing Addendum — form a binding agreement between you and us (together, the “Terms”). If documents conflict, a signed written agreement with us prevails, then the Data Processing Addendum (for personal data processing), then these Terms of Service, then the other policies.
You accept the Terms when you create a Dragy account, or when you install, open or use any part of Dragy, including sending or receiving files without an account or opening a share link. If you do not agree, do not use Dragy.
2. Definitions
- “Dragy” or the “service” — the Dragy software and services we provide: the web app (including the installable version) at https://dragy.nexlla.com/app/, the desktop apps for Windows and Linux (and macOS when released), the Android app (and the iPhone and iPad app when released), our servers, signalling, encrypted relay and temporary encrypted storage, and this website.
- “Apps” — the client software we make available for you to install or run, from our website, an app store or another channel we authorise.
- “Account” — your optional, free Dragy account and the devices signed in to it.
- “Device” — a browser profile or installed App instance running Dragy. A signed-in device has its own encryption key pair, made on that device.
- “Your content” — the files, folders, file names, text snippets, links and anything else you send, receive or share with Dragy.
- “Transfer” — one sending of content to one or more devices or to a share link.
- “Stored transfer” — an encrypted transfer kept temporarily on our servers for an offline device of yours, or behind a share link.
- “Share link” — a link you create that lets anyone who holds it download and decrypt the files you chose, until it expires or reaches its download limit.
- “Nearby” — the feature that shows Dragy devices on the same network to each other.
- “Consumer” — an individual using Dragy wholly or mainly for purposes outside their trade, business, craft or profession.
Headings are for convenience only. Words such as “including” and “for example” are illustrative and don’t limit the general words before them.
3. Eligibility
3.1 Age and capacity
You must be at least 16 years old, or the minimum age of digital consent in the country where you live if that is higher, and have the legal capacity to enter into a binding contract. Dragy is not directed at children, and you must not create an account for a child.
3.2 Restrictions
You may not use Dragy if we have previously terminated your access for a breach of the Terms (unless we agree otherwise in writing), or if you are prohibited from receiving the service under the laws of the United Arab Emirates or any other applicable jurisdiction, including the sanctions laws in section 23.
3.3 Using Dragy for an organisation
If you use Dragy on behalf of a company, employer or other organisation, you confirm that you are authorised to accept the Terms for it. In that case “you” includes the organisation, which is responsible for your use of Dragy, and our Data Processing Addendum applies. Check that your organisation’s policies allow you to move its files with Dragy.
4. Accounts, devices and keys
You can use Dragy without an account — on Nearby, or with a connection code or QR. An account is optional and adds your own devices, delivery to offline devices and share links.
- Accurate information. Use an email address you control and keep it current. We use it to confirm your account, reset your password and send security notices.
- One person per account. Your account is personal to you. Don’t share your password or let others sign in to it.
- Keep sign-in secure. Use a strong, unique password and consider turning on two-step verification. You are responsible for your password, your authenticator app and every device signed in to your account, and for activity that happens through them unless it results from our failure to take reasonable security measures.
- Approve devices carefully. Approve a new device (for example by scanning its sign-in QR code) only if it is yours and in your hands. Every signed-in device can send to and receive from your other devices and, by default, accepts files from them automatically. Check Settings → Your devices regularly and remove any device you don’t recognise, lose or no longer control.
- Your keys stay on your devices. Each signed-in device generates its own private key, which never leaves it. We never have your keys and cannot recover them. If you lose a device, reset it, clear its app data or remove it from your account, its key is gone: transfers waiting for that device can no longer be opened and are discarded, and nobody — including us — can recover them.
- Codes, QR codes and verification. Treat connection codes, sign-in QR codes and share links like passwords. When Dragy shows verification emoji or a security code, compare them on both screens and cancel if they differ.
- Security protections. To protect accounts we may rate-limit or temporarily lock sign-in after repeated failures, end sessions, require you to sign in again, or ask you to confirm your email. These measures are part of the service.
- Tell us about a problem. If you think your account has been compromised, change your password, remove unknown devices and contact [email protected].
5. The service
5.1 What Dragy does
Dragy moves files, folders, text and links between devices. It connects devices directly on the same network or over the internet where it can; where it can’t, it forwards encrypted data through our relay; and for your own offline devices and for share links, it keeps encrypted transfers on our servers for a limited time. Content is encrypted on the sending device and decrypted only on the receiving device. How this works is explained on our Security page.
5.2 Free, best effort
Dragy is currently provided free of charge, on a best-effort basis. Transfers depend on your devices, browsers, networks, firewalls and internet providers, which we don’t control. We don’t promise that any particular transfer will succeed, how fast it will be, or that a direct connection will be possible.
5.3 Availability by platform
The web app, the Windows and Linux desktop apps and the Android app (as a directly installed APK) are available now. The macOS app and the iPhone and iPad app are coming soon; until they are released, references in these Terms to them apply only once they are available. Features may differ between platforms and browsers.
5.4 Limits
To keep the service available to everyone, we apply limits — for example on cloud storage per account and per transfer (section 10), the amount of data relayed per day (currently 10 GB per network address without an account and 100 GB per account), the number of connections per network address, and request rates. We may change these limits as described in section 14.
6. Apps, updates and app stores
6.1 Your licence
Subject to the Terms, we grant you a limited, personal, worldwide, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use the Apps on devices you own or control, and to use the service, for your personal purposes or the internal purposes of the organisation you represent.
Except as the Terms or mandatory law allow, you must not copy, modify, translate or create derivative works of the Apps; decompile, disassemble or reverse engineer them; rent, lease, sell, sublicense or distribute them; remove proprietary notices; or use them to build a competing service. Parts of the Apps are open-source components licensed under their own terms, which take priority for those components.
6.2 Downloads
Download Dragy only from https://dragy.nexlla.com or an official app-store listing under our name. We publish SHA-256 checksums of our installers; check them. Copies from anywhere else may be tampered with, and we are not responsible for them. Some installers may not yet carry a code-signing certificate, so your operating system may warn you before running them (see the FAQ).
6.3 Updates
We release updates, including security fixes. The Windows app and the Linux AppImage check our server for updates and download them automatically, installing them when you quit or restart; the Linux .deb package is updated through your package manager, and the web app updates when you reload it. Old versions may stop working with the service if they are no longer secure or compatible. Please keep Dragy up to date.
6.4 App stores
If you get an App from an app store, you must also follow that store’s terms. The Terms are between you and us only, not the store operator, and we — not the store operator — are responsible for the App, subject to the following.
6.5 Additional terms for Apple devices
These terms apply to any App you obtain from the Apple App Store once it is available:
- Acknowledgement. The Terms are concluded between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content.
- Scope of licence. Your licence is a non-transferable licence to use the App on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for any maintenance and support for the App. Apple has no obligation to provide any.
- Warranty. We are solely responsible for any product warranties not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Product claims. We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that the App or your use of it infringes its intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints or claims about the App go to [Nexlla Creative Agency — registered legal name], [Registered address — street, building, city, Emirate, United Arab Emirates], [email protected].
- Third-party terms. You must comply with applicable third-party terms when using the App, such as your mobile data provider’s.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of the Terms and may enforce them against you.
6.6 Google Play
If you obtain an App from Google Play once it is listed there, Google is not responsible for the App, and your use of Google Play is governed by the Google Play Terms of Service. Today the Android app is distributed as an APK from our website.
7. Your content
7.1 You own it
As between you and us, you keep all rights in your content. We claim no ownership of anything you send, receive or share.
7.2 The limited permission you give us
You grant us a worldwide, non-exclusive, royalty-free licence to transmit, relay, temporarily store, copy and delete your content in encrypted form only, solely to deliver it to the devices or share-link recipients you chose, to keep the service secure, and to comply with the law. The licence includes our hosting and network providers listed on our Sub-processors page, for the same purposes. It ends when the encrypted content is deleted from our systems.
7.3 Your promises about your content
You are solely responsible for your content and for how you use Dragy. You confirm that you own your content or have all the rights, licences and permissions needed to send, store and share it with the people you choose; that sending it does not infringe anyone’s intellectual property, privacy or other rights; and that it, and your use of Dragy, comply with the Terms and the law that applies to you and to your recipients.
7.4 We can’t see your content
Dragy encrypts content on your device before it reaches us. File names, folder names, file contents, text and links are inside that encryption, and we never have the keys. As a result:
- we do not, and technically cannot, monitor, review, scan or moderate your content, and we have no knowledge of what any transfer or share link contains unless someone tells us;
- we act only as a passive intermediary that transmits encrypted data at your direction and, for stored transfers and share links, holds it temporarily — we do not initiate transfers, choose their recipients, or select or modify their content;
- we are not responsible for content that users send, receive or share, to the extent that intermediary-liability laws protect providers of transmission, caching and hosting services (including, where they apply, the EU Digital Services Act, section 512 of the U.S. Digital Millennium Copyright Act, and equivalent provisions under UAE law); and
- when we receive a valid notice about a specific share link, account or device, we act on it as described in our abuse and copyright procedures — usually by disabling the link and deleting its encrypted data, or by restricting the account.
Because we can’t read content, we can’t recover it, provide it to you or anyone else in readable form, or confirm what a transfer contained.
8. Share links
- Signed-in users with a confirmed email address can turn files into a share link for someone who doesn’t use Dragy. Each link has a lifetime you choose (from 1 hour to 7 days) and a download limit (once, 10 times or unlimited). When either is reached, the link stops working and its encrypted files are deleted.
- The decryption key is part of the link itself, after the
#, and is never sent to our server. Anyone who has the full link can download and decrypt the files until it expires or hits its limit, wherever they got it from. - You decide who gets your links, and you are responsible for sharing them only with people entitled to the files, and for what you share through them. You can delete a link at any time in Settings → Cloud & links; downloads already made can’t be undone.
- Don’t post share links publicly or use them as a public download site or content-delivery network.
- We may disable a share link, and delete its encrypted data, if we receive a credible notice that it breaches the Terms or the law — for example that it distributes malware, illegal content or infringing material — or if we are required to by law. A recipient who opens a disabled link sees that it is no longer available. Anyone can report a link at https://dragy.nexlla.com/abuse.html.
9. Acceptable use
You must use Dragy lawfully and follow our Acceptable Use Policy, which forms part of these Terms. In summary, you must not use Dragy to:
- send, store or share illegal content — including, with zero tolerance, child sexual abuse material, which we report to the authorities;
- spread malware or phishing, including through share links;
- infringe anyone’s copyright, trademark, privacy or other rights;
- harass, threaten or spam anyone, including by sending unwanted transfer requests to strangers on Nearby;
- abuse the relay or storage, for example as general file hosting, or evade quotas, rate limits or relay limits;
- attack, probe, overload, reverse engineer or interfere with the service, except for security research under our vulnerability reporting rules;
- create accounts by automated means, or access accounts, devices or data that aren’t yours.
10. Storage, deletion and no backup
Dragy is not a storage, archive or backup service. It exists to move files from one device to another. Nothing is kept after it has been delivered or has expired, deleted data cannot be recovered, and you must keep your own copies of anything that matters.
- Offline delivery. When you send to one of your own devices that is offline, the encrypted transfer waits on our servers. It is deleted as soon as every recipient device has received it, and in any case after 7 days.
- Share links. Deleted when the link expires, reaches its download limit, or you delete it.
- Unfinished uploads. Uploads that are not completed within 24 hours are discarded.
- Quotas. Each account can have up to 5 GB of stored transfers at a time, and each stored transfer can be up to 5 GB. We may refuse new stored transfers when an account, or our storage as a whole, is full. Live transfers between online devices are not counted against these limits.
- Other deletion. Stored transfers are also deleted when you remove the recipient device, delete the transfer, delete your account, or when we act under section 18.
- Relay. Data passing through our relay is forwarded in transit and not stored.
To the fullest extent permitted by law, we are not liable for any loss of content, whether because a transfer failed, expired, was deleted under these Terms, couldn’t be decrypted because a device key was lost, or for any other reason.
11. Nearby and connecting with others
- Who can see you. When Nearby visibility is on, other people running Dragy on the same network — for example the same home, office, café or campus Wi-Fi, or anyone sharing your public IP address — can see your device’s name and type and can ask to send you files. You can turn visibility off in Settings → Privacy & Nearby.
- You choose what to accept. Transfers from devices that aren’t yours always ask first. Only accept transfers you expect, from people you know, and check the verification emoji. Received files may be harmful; scan them as you would any download.
- Your network address may be visible. To connect directly, devices exchange network addresses, so the device you connect with — and the person controlling it — can learn your IP address. Connect only with devices you trust; see our Privacy Policy.
- Choose a sensible device name. Don’t use a name that reveals more about you than you want strangers on the same network to see, and don’t use names that impersonate someone else.
- Other users are not us. We don’t vet the people you connect with and are not responsible for what they send you or do with what you send them.
12. Third-party services
Dragy relies on services run by others, including Cloudflare (network proxy, DNS and the STUN service that helps devices find a direct path), our hosting provider, your browser and operating system, app stores, and your internet provider. They act under their own terms. We are not responsible for their availability, security or actions, and a change they make may affect Dragy. Names of third-party products appear on our site only to describe compatibility; we are not affiliated with or endorsed by their owners.
13. Fees
Dragy, including the account, is currently free, without ads or in-app purchases. We may introduce optional paid features in the future. If we do: we will tell you the price, billing terms, taxes and any renewal or cancellation terms before you buy; you will only be charged if you choose to buy; we will not start charging for a feature you already use without at least 30 days’ notice and the choice not to pay; purchases through an app store will be governed by that store’s billing and refund rules; and nothing will affect refunds or remedies you are entitled to by law, including under UAE Federal Law No. 15 of 2020 on Consumer Protection.
14. Availability and changes to the service
We work to keep Dragy fast and reliable, but it may be unavailable during maintenance, incidents or events outside our control, and live transfers in progress may be interrupted. We provide no service-level commitment or uptime guarantee unless agreed in a signed agreement.
We may add, change or remove features, change supported platforms and browsers, and change limits. If we reduce storage limits or retention in a way that affects you, or remove a feature you regularly rely on, we will give reasonable advance notice where practicable. If we discontinue Dragy entirely, we will give at least 30 days’ notice where we lawfully can, so you can collect anything waiting in the cloud.
Support is provided by email at [email protected] and through our FAQ, without guaranteed response times. Never send passwords, codes or share links to support.
15. Privacy
Our Privacy Policy explains what personal data we handle and why; our Cookies & Local Storage page explains what Dragy keeps on your device; and our Security page explains how your content is protected. If you send content containing other people’s personal data, you are responsible for having a lawful basis to do so.
16. Intellectual property and trademarks
Dragy, the Apps, our website and all related software, designs, text, graphics and documentation (excluding your content and third-party materials) are owned by us or our licensors and protected by intellectual property laws. Except for the licence in section 6, the Terms grant you no rights in them; all rights not expressly granted are reserved.
“Dragy”, “Nexlla Creative Agency”, “Nexlla” and our logos are our trademarks or trade names. You may not use them without our prior written permission, except to refer accurately to Dragy in a way that does not suggest sponsorship or endorsement. To report infringement by a Dragy user, follow our Copyright Policy.
17. Feedback
If you send us suggestions, ideas or bug reports, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use and incorporate them without restriction or obligation to you. We won’t identify you publicly as the source without your permission. Feedback never includes your content.
18. Suspension and termination
18.1 You can leave at any time
You can stop using Dragy at any time and delete your account in Settings → Security → Delete account. Deleting your account signs out every device, deletes your device records and keys held by us, and permanently erases your stored transfers and share links. It cannot be undone. Residual records are removed as described in our Privacy Policy.
18.2 Suspension and termination by us
We may suspend or restrict all or part of your access, disable share links, delete stored transfers, block devices or network addresses, or terminate your account, if:
- you materially or repeatedly breach the Terms or the Acceptable Use Policy, including after valid notices of infringement (see our repeat-infringer policy in the Copyright Policy);
- we are required to by law, a court order or a competent authority, or continuing would expose us or others to legal liability or sanctions risk;
- your use creates a security, fraud or abuse risk to Dragy, its users or anyone else — for example if your account appears compromised or is used to distribute malware;
- the account was created by automated means or with false information; or
- your account is inactive — meaning no device has signed in to it for [24 — confirm] months — and you have not responded to an email we sent at least 30 days before deleting it.
Where reasonable and lawful, we will tell you why and give you a chance to respond. We may act without notice where a breach is serious, where notice could harm an investigation or others’ safety, or where the law prevents notice. If you think we made a mistake, contact [email protected].
18.3 Effect of termination
When the Terms end, your licence ends, and stored transfers and share links of your account are deleted. Sections 7.3, 7.4, 10, 16, 17 and 19 to 30 survive, together with any other provision that by its nature should.
19. Disclaimers of warranties
We provide Dragy with reasonable skill and care. However, to the fullest extent permitted by applicable law, Dragy and the Apps are provided “as is” and “as available”, and we and our suppliers disclaim all warranties, conditions and representations, whether express, implied or statutory, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title and non-infringement.
In particular, we do not warrant that: the service will be uninterrupted, timely, secure or error-free; any transfer will be delivered, complete or fast; a direct connection will be possible; stored transfers or share links will remain available for their full period; files you receive from others are safe or lawful; or that the encryption cannot be defeated by a compromised device, malware, or someone who obtains a code, key or link.
20. Limitation of liability
20.1 Excluded losses
To the fullest extent permitted by applicable law, neither we nor our affiliates, officers, employees, agents, suppliers or licensors will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, anticipated savings or data, or business interruption, arising out of or in connection with the Terms or the service, however caused, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if advised of the possibility.
Without limiting the above, we are not liable for: content you or others send, receive or share; transfers that fail, are interrupted, expire or are deleted under the Terms; loss of access to content because a device key was lost; anything done by someone who obtains a code, sign-in QR code or share link from you or your devices; files you accept from other users; disclosure of your IP address to devices you connect with; or unauthorised access resulting from your failure to keep your devices and sign-in secure.
20.2 Cap
To the fullest extent permitted by applicable law, our total aggregate liability arising out of or in connection with the Terms and the service is limited to the greater of (a) the amounts you paid us for the service in the 12 months before the event giving rise to the first claim, and (b) USD 100.
20.3 What is not limited
Nothing in the Terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, gross negligence or wilful misconduct where the law does not allow it to be limited, or under mandatory consumer protection law. The limits reflect that Dragy is provided free of charge.
21. Indemnity
To the extent permitted by applicable law, you will defend, indemnify and hold harmless us and our affiliates, officers, employees and agents against third-party claims, and related losses, liabilities, fines, costs and reasonable legal fees, arising from: (a) your content; (b) share links you create and how you distribute them; (c) your breach of the Terms or the Acceptable Use Policy; or (d) your violation of any law or third-party right. We will notify you promptly of a claim, let you control its defence (but you may not settle a claim that imposes obligations on us without our written consent), and cooperate reasonably at your expense.
If you are a consumer, this section applies only to the extent the loss is caused by your breach of the Terms or your unlawful conduct, and only as far as the mandatory laws of the country where you live allow.
22. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, epidemics, war, terrorism, civil unrest, government action, failures of the internet, power, hosting, network or telecommunications providers, cyber-attacks that could not reasonably have been prevented, or acts of third-party services. We will use reasonable efforts to limit the effects and resume the service.
23. Export controls and sanctions
Dragy contains encryption software and may be subject to export control and economic sanctions laws, including those of the United Arab Emirates, the United Nations Security Council, the United States, the European Union and the United Kingdom. You represent that you are not (a) located in, ordinarily resident in, or organised under the laws of a country or territory subject to comprehensive sanctions or embargo; (b) on, or owned or controlled by a person on, any applicable sanctions or restricted-party list; or (c) otherwise prohibited from receiving the service. You must not use, download, export, re-export or transfer Dragy in breach of those laws, for any prohibited end use, or in any embargoed jurisdiction, and you are responsible for complying with any local laws on importing or using encryption. We may suspend access immediately where needed to comply with these laws.
24. Electronic contracting and notices
The Terms, and notices and other communications between us, may be made and accepted electronically, with the same effect as paper documents and signatures, in accordance with UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services and equivalent laws elsewhere. We may give you notices by email to your account address, in the Apps, or by posting on this website for notices of general application; email notices are treated as received 24 hours after sending unless we receive a delivery failure. If you use Dragy without an account, notices on this website are how we reach you. You must send legal notices to us by email to [email protected], with a copy to [Nexlla Creative Agency — registered legal name], [Registered address — street, building, city, Emirate, United Arab Emirates] when serving formal legal process. You can save or print these Terms from this page.
25. Changes to these terms
We may update the Terms to reflect changes in Dragy, the law or our business, and will post the updated version here with a new “Last updated” date. If a change is material and adverse to you, we will notify account holders by email or in the Apps at least 30 days before it takes effect. Shorter notice may apply where a change is required by law or needed to address a security risk. If you don’t agree, stop using Dragy and delete your account before the change takes effect; continuing to use Dragy after that means you accept the updated Terms. Changes do not apply retroactively to disputes that arose before them.
26. Governing law and disputes
26.1 Governing law
The Terms, and any dispute or claim (including non-contractual ones) arising out of or in connection with them or the service, are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
26.2 Informal resolution first
Before starting formal proceedings, you and we agree to try to resolve any dispute informally. The party raising it sends written notice — to us, by email to [email protected] — describing the dispute, the relief sought and how to reach them. Both parties then negotiate in good faith for at least 30 days. This does not stop either party from seeking urgent interim or injunctive relief, for example to protect intellectual property or the security of the service.
26.3 Courts
If the dispute is not resolved informally, it is subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates. Alternatively, you and we may agree in writing, when the dispute arises, to submit it to the courts of the Dubai International Financial Centre (DIFC).
26.4 Time limit
To the extent permitted by applicable law, any claim relating to the Terms or the service must be brought within one year after the cause of action arose.
27. Your statutory rights
Nothing in the Terms limits rights you cannot waive. If you are a consumer, nothing in the Terms — including sections 19 to 21 and 26 — deprives you of the protection of the mandatory laws of the country where you habitually reside, including UAE Federal Law No. 15 of 2020 on Consumer Protection for consumers in the UAE, or of any right to bring proceedings in the courts of that country where those laws give you that right. Where a provision of the Terms is not allowed by the law that applies to you, it applies only to the extent that law permits.
28. General
- Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the rest remains in full force.
- Assignment. You may not assign or transfer your rights or obligations under the Terms without our prior written consent. We may assign the Terms to an affiliate or in connection with a merger, acquisition, reorganisation or sale of the business or assets relating to Dragy, provided your rights are not reduced; we will notify account holders.
- Entire agreement. The Terms (including the documents in section 1) are the entire agreement between you and us about Dragy and replace any prior agreements or understandings on the same subject. Nothing in this clause limits liability for fraud.
- No waiver. Not enforcing a provision, or delaying enforcement, does not waive our right to enforce it later. A waiver is effective only in writing.
- Relationship. Nothing in the Terms creates a partnership, joint venture, employment or agency relationship.
- Third-party rights. Except for Apple and its subsidiaries under section 6.5, no third party has any right to enforce the Terms.
29. Language
The Terms are written in English. We may provide translations for convenience; if a translation differs, the English version prevails, except where mandatory law requires otherwise. Where a court or authority requires an Arabic translation, the parties will cooperate to provide one.
